TERMS OF SERVICE — POLAIR

1. Who we are. This store ("Polair", "we", "us") is operated by Polair, The Circle 6, 8058 Zürich-Flughafen, Switzerland. Contact: support@getpolair.com.
2. Acceptance. By using the site or ordering you agree to these Terms and our Privacy, Returns & Refund and Limited Warranty policies, incorporated by reference.
3. Eligibility. You must be at least 18 and able to contract. Products are for personal, non-commercial use unless we agree otherwise in writing.
4. Orders & our right to refuse. Your order is an offer; a contract forms only when we send a dispatch confirmation. To the maximum extent permitted by law we may refuse, limit, cancel or unwind any order or quantity — including after payment — for any reason (suspected fraud, pricing/stock errors, reseller/bulk activity, prior policy abuse, or undeliverable locations). If we cancel a paid order we refund the amount paid for the cancelled items, which is your sole remedy for that cancellation.
5. Pricing & errors. Prices are in CHF/EUR and may change without notice. We may correct obvious typographic, pricing or description errors and cancel affected orders even after confirmation.
6. Payment. You authorise us and our processors to charge your method and confirm it is yours and authorised. We may fraud-screen and decline high-risk transactions.
7. Shipping & risk. Delivery dates are estimates only and not guaranteed; we are not liable for carrier delays. Risk passes on delivery.
8. Returns & warranty. Governed by our Returns & Refund Policy and Limited Warranty. Except where mandatory law requires otherwise, returns require our prior written authorisation (RMA) and we may refuse returns that do not meet those conditions.
9. Acceptable use & IP. No misuse, scraping, reverse engineering, or unauthorised commercial resale. The "Polair" brand, content and trademarks are owned by us or our licensors.
10. Disclaimers. To the fullest extent permitted by law, site and products are provided "as is" except for warranties expressly granted in our Limited Warranty.
11. Limitation of liability. To the fullest extent permitted by law, our total aggregate liability for any order is limited to the amount you paid for the product(s) concerned, and we exclude indirect, incidental, consequential or punitive damages and loss of profit, data or goodwill. Nothing excludes liability that cannot lawfully be excluded (e.g. unlawful intent/gross negligence, personal injury, mandatory consumer-law liability).
12. Indemnity. You indemnify us against claims arising from your breach of these Terms or misuse of products.
13. Force majeure. Not liable for delay/failure beyond our reasonable control.
14. Changes. We may update these Terms; the version in force when you order applies.
15. Governing law & jurisdiction. Swiss law applies, excluding conflict-of-laws rules and the UN CISG. Exclusive place of jurisdiction is Zürich, Switzerland. For consumers, this does not remove the mandatory protections of your country of habitual residence.
16. Severability & consumer rights. Unenforceable provisions are severed; the rest stands. Nothing in these Terms affects mandatory statutory consumer rights, which prevail over any conflicting term.
